e-Filing NOW AVAILABLE for Civil Cases at the Metropolitan Court 

e-Filing is now available for attorneys in civil cases in the Metropolitan Court for both initial and subsequent filings.  It will become mandatory for attorneys on October 15, 2020 

Attorneys must add themselves as a Service Contact to each case in which they are counsel of record before October 15, 2020 in order to receive eFiled documents from the Court.

Proposed Text Documents

Proposed Text documents are documents that need to be reviewed and signed by the judge; they are not filed through File & Serve.  Proposed Text documents are submitted via email to the judge assigned to your case.  For email addresses, click here

Proposed Text Documents are to be sent to the judge assigned to your case except as noted below:

Application for Free Process (should be sent to Presiding Civil Division Judge Frank Sedillo at metrodiv5proposedtxt@nmcourts.gov);

Orders (should be sent with a courtesy copy of any Motion that has been e-Filed);

Judgments, including Judgments on Writs of Garnishment and Default Judgments (to be sent with a courtesy copy of any Complaint/Petition, Answer, Application/Motion for Default Judgment, Certificate as to the State of the Record, or Affirmation [of Non-Military Service] of Plaintiff in Support of Application for Default Judgment that has been filed or e-Filed); and

Release of Garnishment.


Metropolitan Court - Civil Cases with No Filing Fees Charged:

Applications for Free Process – Rule 4-222 NMRA

Applications for Free Process are emailed to Presiding Civil Judge Frank Sedillo at metrodiv5proposedtxt@nmcourts.gov.

The Court will notify the attorney if the Application for Free Process has been approved.

If the Application for Free Process has been approved, when the attorney starts a new case in File and Serve, the attorney should include the approval of the free process that the attorney has received from the Court and should select “waiver” as the “payment account” option.

 Wage Claims – There is no filing fee for wage claims brought under NMSA 1978, § 50-4-26(E), and the attorney would select “waiver” as the “payment account” option in File and Serve.
