Criminal Record Expungement; Applying Automatic Expungement to Records Involving Cannabis

This form allows you to apply for your cannabis (marijuana) criminal records to be expunged according to the Criminal Records Expungement Act. NMSA 1978 29-3A-1 et seq.

If you have a case record involving cannabis, you may request that this charge be cleared.

If your case record involves charges other than cannabis related charges, you may petition the court to expunge all charges.  Click here to learn more.

Entering a Case Number

The typical format for a court case in New Mexico looks like this: D-202-CR-2023-0000. Older cases may not have the full year, or all of the dashes. The leading letters and numbers refer to the court type and case type and may also be different. Please enter whatever you have in your records.

If your case was heard in a magistrate court, contact the district court in the judicial district where the magistrate court is located. Click here for a map of judicial districts to help in finding the right court location.

It is also possible that your records are from a law enforcement agency. Please enter whatever information you have so that the court can determine if it is able to assist you.

If your case is not eligible for automatic expungement process for cannabis-related charges it could still be eligible for expungement. There are two additional expungement processes: one for charges and records associated with a previous conviction, and another for charges and records from cases that did not result in a conviction.     If the court records you are requesting to have expunged do not specifically state cannabis or cannabis paraphernalia, you cannot use this online automatic expungement request. However, you may still request expungement using the court petition process for expungement of criminal public records if you were convicted of a violation of a municipal ordinance, misdemeanor or felony, and no other charges or proceedings are pending against you anywhere.
